I was signed up by Phil Long Ford, who led me to believe I was entering a payment system directly with the lender, for biweekly payments. I was not informed of the 399.99 sign up fee or of the 1.95 debit fee for each withdrawal. What Smart Payment Plan actually did was pay the minimum amount, by check, 5 days before payment was due in the California based bank. Smart Payment Plan is in Florida. I cancelled and filed complaints. I was promised the 399.99 returned and also asked for the 20.01 they withdrew but did not pay. I haven't seen a dime in over 8 months. BBB FTC and AG complaints have been filed

We apologize for any misunderstanding you had of the contract. The contract provided at the time of enrollment outlines the lifetime (deferred) enrollment and debit fees associated with the program in which you enrolled. Also stated in our contract are all fees are non refundable. As a courtesy, however, we refunded the amount collected towards the enrollment fee. This was deposited back into your checking account on 05/15/2014.
Please note at no time was the enrollment fee of $399 collected in full. Your deferred enrollment fee is retained from your accelerated debits.
We are a nationwide company. The payments were made to your CA lender by check because they don't accept electronic transfers. The accelerated payments are part of the deferred fee and term reduction.
