In January I agreed to work with Home Relief Assistance to modify my current mortgage. I paid them $3400 to be a liaison between myself and my mortgage company. After 10 months of them working on my case they have now decided that I have breached my contract by not submitting papers on time so they are closing my file. I did not breach my contract and I have the fax confirmations with the dates that the papers were sent proving that I sent them on the dates that they were requested. I also emailed them numerous times asking for confirmation that they received my paperwork and received no response from them until weeks later. I emailed and left voicemails often trying to get information on the status of my account and to see what they needed from me however I often would not hear back from them. On October 7, 2011 I received a letter from HRA stating that they were closing my file because I breached my contract by not submitting paperwork. When I called them to discuss this letter and told them that I had submitted that paperwork and never received a response on whether they got them I was told that they have been working on my case for too long and they can no longer do so because it is costing them too much money. I then stated that if they cannot work on my case then I would like my money back because that is what the contract states will happen and I was told that I breached the contract so there would be no refunds and they no longer wished to discuss this with me and then hung up on me. I noticed on the Better Business Bureau complaints most of the time they are stating that the client breached contract for not submitting paperwork on time. That seems to be there way around the contract. I just want a portion of my money returned since they did not provide a modification for me.
